New compliance laws

Maryland now requires independent parties for board elections

Maryland enacted the HB 1534/SB 758 election provisions as Chapter 512, effective October 1, 2025. Covered HOA and condominium governing-body elections, including collecting and counting ballots and certifying results, must be conducted by independent parties who are not candidates and have no conflict regarding a candidate.

The enacted text says ordinary property-management representatives are not independent parties, with an exception for association-owned management. It also expressly permits a third-party vendor or commercial technology platform. vote.direct can supply that platform and its election record; the association should confirm that the contracted service scope satisfies the law for its election.
